We can’t always get what we want, to
paraphrase the song. An Alberta divorce
usually becomes the final option when both man and woman in a married
relationship are unable to see eye-to-eye on things. And the last thing you want is for that
divorce to become contested.
How can a divorce become contested? Well, there are many reasons. One of them is custody. Talks about custody can turn into a battle of
“he said” versus “she said” over how the other party prefers to do his/her
parenting. One party can call the other
an “unfit parent” and it could degenerate from there. Accusations of infidelity and spousal abuse
can also convolute things and make a divorce contested. The party being accused of such would deny
what the other party is saying. And when
a divorce becomes contested, what invariably happens is the whole thing being
decided by a judge, in a court of law.
When filing for divorce, you want to be in control of the situation. That’s not going to happen often if a divorce
is a contested one.
What you should aim for instead is an
uncontested divorce. There are many ways
you and your spouse can come to terms, such as mediation and arbitration. Uncontested divorces are far less stressful
on both husband and wife, and even the children, if any. Most couples who go through this type of
divorce end it all in good terms with one another. There will never be such a thing as a really
“good divorce”, but if your Alberta divorce is uncontested, at least you know
you’re in control of things.
